Terms & Conditions

These Terms form the basis of the contract between our customer and Buttercup Cakes.

Wedding Cakes

These Terms, your Order and your Order Confirmation, are considered by us to set out the whole agreement between you and us for the sale of wedding cakes.  It is your responsibility to check all details in the order confirmation are complete and accurate, as this is the document we will work to when completing your order.

Basis of Sale

Any samples, drawing or descriptions we issue and any descriptions or illustrations contained on our website and social media are issued solely to provide you with an approximate idea of the cakes they describe and remain the property of Buttercup Cakes.

Quotations are valid for a period of 7 calendar days from the date of issue.  No contract is made with you until we have received your deposit.  Once your deposit has been received, you are in a legally binding contract with Buttercup Cakes.

Payment Structure

A  £100  non refundable and non transferable deposit is required to secure your booking.

Cleared payment of the entire balance must be received no later than 6 weeks before the cake is required. Cleared payment of the entire balance must be received by the due date for work on your cake to be completed. When payment is late, we accept no responsibility should we be unable to purchase the required stock or equipment to make the cake as set out in the order confirmation.  In these circumstances, the cake will be made as close to the order confirmation as possible, with no redress or liability on Buttercup Cakes.

In the event of non-payment of the balance, we reserve the right to cancel the order and the deposit is forfeited.

Cake orders which are cancelled at short notice, less than 6 weeks prior to the wedding), will still be charged for in full, as we are rarely able to rebook dates at such short notice. Any work already carried out or items ordered in for your order are also chargeable.

As we are pricing for events well into the future, we reserve the right to add an increase to the cost of the cake if our costs rise significantly.  This will not exceed 10% of the quoted price.

Alterations

Where possible we will accommodate changes you wish to make to your cake order but this may incur additional cost.  No changes can be made less than 6 weeks prior to delivery/collection.

From time to time, certain ingredients and materials for our cakes may become obsolete or we are unable to source them.  This is totally out of our control, however, we will do our best to select replacement products to reflect the original design as closely as possible. We reserve the right to replace the items with component parts of equal or better quality, without consultation.

Cake Delivery/Collection

As part of our service, we offer a personal delivery and set up service for wedding cakes.  This service is subject to availability and advance booking is essential. We will liaise with your venue prior to delivery to schedule a delivery slot and check that all arrangements for assembly such as cake stand and table have been taken care of.  Please contact us for a delivery quotation.  If the delivery address changes after the order has been confirmed, additional charges may be added to cover the extra mileage.

Please note: At point of delivery, the cake becomes the responsibility of the venue.  This is confirmed, where possible,  in the form of a signature by a nominated person e.g. your wedding planner or other member of staff at your venue.  We will take photographs of the cake before leaving. We are unable to accept any liability for any damage sustained to the cake thereafter not any failure to follow the instructions provided.

Collection – If you wish to collect your order from Buttercup Cakes we will provide you with transport, assembly and storage instructions where required. We will give you a collection time and we will contact you should any changes to the time be necessary.  Should for any reason an order not be collected, we will endeavour to contact you to re-arrange a new time for collection, however we do not offer refunds or replacements for orders that have not been collected at the agreed date and time.

Once collected, the full responsibility for the safety of the order is with the client and we are not liable for any damages thereafter.

Fresh Flower Usage

In the case of fresh flower usage, the responsibility for the flowers’ safety, quality, freshness, colour and safe food practice, will rest with the florist and not with Buttercup Cakes.

Naked, Semi Naked and Buttercream Finish Cakes

These types of cake are not as stable as a fully iced cake and in hot weather or in a hot venue, the buttercream can soften or melt, which can cause the cake to settle or slide.

Allergies

Buttercup Cakes products contain butter (Milk), gluten (wheat) and eggs and are made in an environment that handles nuts, soya and alcohol.  Nut, gluten, dairy and alcohol free cakes can be made on request, however we cannot guarantee there has been no cross contamination due to the nature of production. Please note that some food colourings may have an effect on behaviour in children.

Allergen information will be provided to the venue at time of delivery.

Buttercup Cakes accepts no liability to customers suffering from an allergic reaction from eating our products.  It is the client’s responsibility to inform all parties consuming a Buttercup Cakes product of the afore mentioned.

Complaints

All cakes require a signature on delivery/collection. This indicates you are happy with the product received. If you are not happy please ensure you make this known when accepting your cake. This gives us the opportunity to correct any problems. We are not responsible for mistakes made by the customer or incorrect choice of cake. We always keep samples of our products for a reasonable time. In addition we always take photographs of the cakes prior to delivery /collection and also when the cake is set up at the venue.

Complaints are extremely rare. Some complaints may require further investigation and an immediate refund may not always be possible. Cakes, or part of cakes and cupcakes, must be returned to us within 24 hours to ensure we are able to fairly assess the nature of the complaint. The cake must have been stored at the correct temperature and in the box we supplied, out of the sun and away from damp conditions or heat. If you are complaining for a refund you must return at least 75% of the uneaten product within 24 hours of delivery/collection.

We do not refund for customers that have simply changed their mind or if the cake has been damaged out of our care.

Please note is it very common for icing to crack as it dries out which is out of our control and why we recommend you consume your cake as soon as it is cut. We do not accept complaints for not liking the taste of our products mainly because individual’s tastes are different.

Please note we can only deal with the customer who originally placed the order.

Our Products

Products made by (Company name) are made by hand and accordingly there will be minor variations in appearance. All photos, illustrations and descriptions displayed on our page are for guidance purposes only.

Storage

All cakes/cupcakes should be placed on a flat surface and stored at room temperature in the box provided. They should be kept out of direct sunlight. Freezing or refrigerating our cakes or cupcakes is not recommended. Please note cupcakes should be consumed within 2 days and cakes within 3 days.

Cancellations

If the order is cancelled by the customer, charges are as follows:

More than 90 days before the agreed date – deposit

Ninety days to six weeks prior to the date – deposit plus half the remaining cost.

Less than six weeks prior to the date – full amount is due.

The deposit is non-refundable and non-transferable, plus any expenses already incurred by Buttercup Cakes in respect of the order, will be chargeable.

Cancellation by Buttercup Cakes: We shall not be liable for any failure to perform, where such failure or delay results from any circumstances outside our reasonable control including but not limited to any fire, flood, explosion, accident, adverse weather conditions, traffic congestion, mechanical breakdown, obstruction of any private or public highway, riot, government act, act of war, terrorism, act of God, or from any industrial dispute or strike whatsoever.

In the event of exceptional circumstances, such as serious illness, Buttercup Cakes will give as much notice as possible if we are unable to fulfil your order. We will endeavour to find someone else who can produce your order and will refund you any monies already paid.

Postponement

Postponements are subject to the same payments as a cancellation. Buttercup Cakes will transfer  any payments made to a new wedding date, providing we have availability for that new date.   If the new date is not available, the deposit cannot be refunded or transferred.  We are only able to transfer a booking on one occasion.  Any further postponements will be treated as a cancellation.

Cake Stand Hire

A security deposit is payable in addition to the hire charge.  It is the responsibility of the client to return the cake stand to the premises of Buttercup Cakes, undamaged, within three working days of the wedding.   When the cake stand is safely returned, the security deposit will be refunded.  If the stand is not returned or returned damaged, the security deposit will not be refunded.

Intellectual property

All designs and intellectual property rights remain the property of Buttercup Cakes.

We reserve the right to use images of your cake for any form of advertising and promotion, including web-based promotions, social media, brochures, galleries and competitions.

In Person Classes

Please use the online booking system in the online shop area of this site. Any place/places are not secured on one of our classes until a full payment has been made and you have received a confirmation by email from Buttercup Cakes. You will receive a separate email from PayPal /Stripe but this is not a confirmation of a class place so do not make any arrangements purely relying on this email.
You will be sent all the details of the class by email including location etc.

We are unable to offer a refund should you decide to cancel or are unable to attend your class at Buttercup Cakes for any reason. If you are unable to attend, subject to availability and at Buttercup Cakes sole discretion, we will try to transfer the booking to a future class. Transfers will incur a £25 administrative fee.

Please double check dates and travel arrangements before you make a booking.  We cannot be held liable for any money spent, such as travel arrangements, hotel bookings for any cancelled classes or if you have to cancel your course.  It is important to have the appropriate insurance in place that will cover any additional costs of cancellation.

If Buttercup Cakes has to cancel a class for any reason, then we will offer an alternative date(s) to you. If we cannot offer you an alternative date we will provide you with a full refund of the cost of your class.  The refund amount will be limited to the cost of the class.  If you have already made travel and accommodation bookings, these would need to be reclaimed via your own insurance policy.

Course content is subject to copywrite and is for personal use only.  It is not to be resold or re-taught.

Online Classes, Tutorials, Recipes and Downloads

No refunds are given for these products as the digital nature means that the content is available immediately.

Privacy Policy

Buttercup Cakes is committed to protecting your privacy. We only hold the minimal personal data required to fulfil your order. Your data is held solely to facilitate your order and for the purpose of effective communication between the customer and Buttercup Cakes. We do not sell, lease or pass on the information you provide to third parties, unless legally required to do so.  However, our accountant and website provider do have access to limited data, and have their own privacy policies.

Payment Processing – we work with trusted third party payment processing providers in order to securely take and manage payments.

We take appropriate security measures to protect your personal information. All digital information held by Buttercup Cakes is held on a laptop or phone which is password protected.  These passwords are updated regularly and the devices have the relevant security software.

We will keep your information for as long as we need it for the purpose it is being processed and our obligations under other laws.
